Who we are

Nestablish operates these sites. Builder Growth Solutions is a Nestablish company. Nidify® is a Nestablish product and a registered trademark.

Nestablish is not a lender. Builder Growth Solutions is not a lender. Nidify® is not a lender. We do not originate loans. A licensed loan officer of the buyer’s — or, for a builder request, the builder’s — choice handles any actual loan.

What this policy covers

This policy explains what we collect on the two public sites, how we use it, and who we share it with.

• www.buildergrowthsolutions.com is the builder marketing site. It has consult, specs, and horizontal request forms. Some buttons leave this site for nidifyapp.com.
• nidifyapp.com is the Nidify® app. Consumers run estimates. Builders and listing agents register, create a QR, and receive attributed leads.

If you only use one site, we still apply this policy to the information that site collects.

Information we collect

We collect what you give us and what we need to run the sites. We do not collect Social Security numbers. We do not pull credit reports. We do not take a loan application (a 1003 or anything like it).

Builder Growth Solutions — specs and horizontal requests

If you submit the request form on www.buildergrowthsolutions.com, we collect:

• name
• builder / company
• work email
• office phone (optional)
• Texas city or county
• what you need (spec financing, help selling a spec, or horizontal financing)
• how many specs (optional)
• notes you choose to add

That submit is a request. It is not a loan application.

Nidify® app — partner accounts

If you register on nidifyapp.com as a builder or listing agent, we collect:

• name
• email
• password
• role (builder or listing agent)

We keep the password so you can sign in.

Nidify® app — consumer estimates

If you run an estimate, we collect the answers you enter and the labeled results the tool shows:

• veteran yes / no
• lot path (own the lot, or buy one)
• lot figures you enter
• construction budget
• extra cash you choose to add
• scenario results (cash to close / down payment, interest-only on draws, amortized payment, program modeled)

Those numbers are estimates. They are labeled as estimates.

Nidify® app — guide opt-in

After an estimate, you may ask for the guide and your scenario. We collect:

• email and/or cell
• the consent checkbox (contact + receive the guide + the scenario)

That opt-in is not a loan application.

Transactional mail you asked for — the guide and your scenario — comes from hello@nidifyapp.com.

QR attribution

If you scanned a partner’s QR, we record that the scan belongs to the partner who created the code. We share that contact with that partner. See “Who we share with.”

Optional soft credit request

The estimate tool may let you ask a licensed loan officer to run an optional soft credit pull. That request is optional. It is not an application we process. We do not underwrite. We do not pull a credit report. It is not a promise of approval.

Cookies and site logs (both sites)

We use cookies and similar tools to operate and understand the site. That includes keeping a signed-in session and ordinary server logs (for example, browser type, pages requested, and time).

How we use it

We use this information to:

• run the estimate you asked for
• send the guide and scenario you asked for
• attribute a QR lead to the partner who created the code
• answer a specs or horizontal request
• keep a partner account working, including the QR that partner created
• operate, secure, and understand the sites
• meet legal duties we cannot ignore

If we send marketing email, that is a different send from Instantly, with its own postal footer. It is not the transactional guide-and-scenario mail from hello@nidifyapp.com.

We do not use these forms to originate a loan. We do not quote a rate on the sites.

Who we share with

The partner on that QR. If you scanned a builder’s or listing agent’s code, that lead belongs to the partner who created it. We share your contact — and that you ran an estimate or claimed the guide — with that partner. That is attribution, not a sale of a list.

Service providers. We use companies that host the sites, send email, and run our CRM. HubSpot is our CRM of record. Those providers process information on our instructions so we can operate the sites and keep the records you asked us to keep.

Specs and horizontal connections. If you ask about spec financing or horizontal financing, we may connect you with our network of lenders. That is a connection. It is not a loan. It is not a named lender. It is not a promise we will get you a loan. We do not originate.

We do not sell personal information. We do not share personal information to get someone a loan from a named lender.

We may share information if the law requires it, or to protect Nestablish, the sites, or other people from harm or abuse.

Estimates are not applications

Nidify® estimates are education and planning numbers. They are not a commitment to lend. They are not a loan. They are not an approval. They are not financial, legal, or tax advice.

A licensed loan officer of the buyer’s choice handles any consumer loan. A licensed loan officer of the builder’s choice handles any loan that builder actually pursues.

We do not sell personal information. We have not put a “Do Not Sell” control on these pages because there is no sale to turn off. We have not appointed a data-protection officer for other countries; these sites are run for a United States audience.

Retention

We keep information as long as we need it to operate the account, to keep the estimate you asked us to keep, and to meet legal duties. We do not publish a fixed year count.

Children

These sites are not for anyone under 18. They are not directed at children. We do not knowingly collect personal information from children.

Changes

We will update this page when the policy changes. The effective date at the top will change. Continued use of the sites after an update means you accept the updated policy.
