Agreement

By using either site, you agree to these terms. The operator is Nestablish.

If you do not agree, do not use the sites.

The sites and the tool

www.buildergrowthsolutions.com is a marketing site for builders. It explains the tools and can take a specs or horizontal request.

nidifyapp.com is the Nidify® app. Consumers run construction-to-permanent estimates. Partners register and create a QR.

The sites and the tool are education and estimates. They are not a loan. They are not a commitment to lend. They are not an approval. They are not financial, legal, or tax advice.

Nestablish is not a lender. Builder Growth Solutions is not a lender. Nidify® is not a lender. We do not originate. A licensed loan officer of the buyer’s — or, for a builder request, the builder’s — choice handles any actual loan.

Names and marks

Nidify® is a registered trademark of Nestablish. Builder Growth Solutions is a Nestablish company. You may refer to the names as they appear on the sites. You may not use the marks as if they were yours, or as if Nestablish, Builder Growth Solutions, or Nidify® were a lender.

Partner accounts

Partner registration on nidifyapp.com is for builders and listing agents who want a QR.

You are responsible for your account, your password, your QR, and how you use that code. We attribute scans of your code to you. If someone uses your QR, we treat that lead as yours.

Do not create a QR for someone else’s listing or job site without the right to put it there.

Consumer use

Numbers in the estimate are estimates. You can change the inputs. You pick your own builder. You pick your own licensed loan officer.

If you scanned a partner QR, the lot price may already be filled in. You can change it. The partner who created the code is the one who sent you here.

Claiming the guide and scenario is optional. It is not a loan application.

Specs and horizontal requests

A specs or horizontal submit on www.buildergrowthsolutions.com is a request, not a loan application.

We may connect you with our network of lenders. We do not originate. We do not quote a rate on the site. We do not promise we will get you a loan. A licensed loan officer of your choice handles any actual loan.

Acceptable use

You may not:

• scrape the sites or harvest emails
• impersonate Nestablish, a partner, a lender, or another person
• use the estimate tool as if it were a loan file
• break or overload the sites
• copy the tool or the marks for a competing product
• use the sites for anything unlawful

We may close an account or block access if you break these terms.

Intellectual property

Nestablish owns the sites, the tool, the copy, the layout, and the marks, unless a line says otherwise. These terms give you a limited right to use the sites as they are offered. They do not transfer ownership.

Disclaimer of warranties

The sites and the estimates are provided as-is. We do not warrant that an estimate matches a future loan, a future rate, or a future approval. Planning numbers can be wrong. You are responsible for the inputs you enter.

To the fullest extent Texas law allows, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent Texas law allows, Nestablish, Builder Growth Solutions, and Nidify® are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost business, arising from the sites, an estimate, a QR, a specs or horizontal request, or these terms.

We are not liable for a lender’s decision, a builder’s decision, or a loan officer’s decision. We did not make those decisions.

Indemnity

If you are a user or a partner, you will defend and indemnify Nestablish, Builder Growth Solutions, and Nidify® against claims that arise from your misuse of the sites, your QR, your impersonation of another person, or your use of the tool as if it were a loan file.

Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Venue is Texas.
